Estate Agents exist for one reason, to sell houses to clients in a professional manner and not to involve themselves in disputes between divorcing couples: that is the lawyers job.  One unbelievably asinine statement we received from a 'professional' emlak was, "If it's easy..it ain't fun".  So, remember that, all you retired people who came to Turkey for an easy stress free life.  Naturally, to move to a foreign country and expect everything to run smoothly and just fall into place would be unrealistic but I would hardly call problems, however small, fun!  It beggars belief.

I visited Eyes of Didim Complex December 12 2010 and I was shocked to find many properties had been broken into and all furniture removed from these proprties, even the bathroom fittings.  I am one of the buyers on Eyes of Didim that had to pay £10,000 extra to pay the outstanding debt on my property (which DDG Builders have amassed) and finally get my Tapu. I am one of a few on Eyes of Didim that had to do this.  On top of the full payment for the property and the extra 10K, I also paid Didim Design Group Builders £1300 in 2009, to help me process my Tapu and military permission.  DDG Builders did nothing for this £1300 and have refused to repay me the money.
We have just been informed that 5 more creditors have come forward with prommisory notes written out and used as garantees against Eyes of Didim Complex, putting Eyes of Didim buyers who do not have Tapu yet into even more debt if and when these debt/notes are paid.
Do not buy property from Didim Design Group Builders or MTA Design Bulders.
Their other project at Golden Beach Complex at Inbat near Altinkum is in a similar situation with more in-justice to come out there once the Golden Beach Complex Landowner gets the temporary injunction lifted later this year.

 

This proves that the justice system works, it's how you go about it that matters.
 

A friend came to me about 18 months ago, he was looking for a property to rent for a couple who was in a desperate situation.  I found a couple who wanted to rent and I listened to their horror story.  They had dealt with a Company called ???? and had bought a villa on a complex off plan and by the time it was completed they had made all payments.  During the building time they also purchased an apartment from the same Company, also off plan.
When they moved into the villa they had a huge snagging list, which included flooding whenever it rained but they struggled to get any of the repairs done.
The final payment and completion date came for the apartment, so before making that payment they went to check, knowing the problems they had come across in the villa.
They went to the apartment only to find that there were no doors or windows fitted, so they refused to make the final payment. The Company then threatened to rip up BOTH contracts, even though they had paid in full for the villa, so they went to a lawyer.  After numerous court appearances along with a 22,000 Euro lawyer’s bill, they were getting nowhere, in fact, the lawyer kept missing court dates and “a new case” had to be opened several times because of her lack of appearance.  It turned out that her husband (a local Mayor), had money invested with ????.  The lawyer then contacted the  couple to say that ???? wanted rental money from them for their villa, as the Tapu was not in the couple’s name.  They were told, ‘Pay rent or get out’.  Their lawyer advised them to get out, which they did, even though they had paid in full.
I told them not to continue paying the lawyer and asked them to write down ALL payments and dates relating to both properties.  I then took their paperwork and “vetted it”, put it all into story form and separated the villa from the apartment to make it easy reading.
I then had that document translated and notarised, the Notary made the comment “if this document is true someone is in trouble”. 
We then made photo copies and sent these to the following: British Embassy, Turkish Prime Minister, Turkish President, Turkish Law Office, HSM and the lawyer.
All were posted by recorded delivery, with the exception of ????, to whom we had hand delivered, naturally, they refused to accept it.
The responses were: The lawyer went completely crazy, why? Because her costs and sorry performance were also highlighted, she said it was her job to get the situation resolved not the Government, next was the British Embassy, “sorry we do not get involved in property deals”.  All went quiet for a couple of weeks, then a letter came to a PO Box that the couple had opened, in order to keep their address secret.
The letter was in Turkish and from Ankara, we took it to my lawyer/translator to find out that Ankara had opened a “criminal case” against ????, not using Didim police but Aydin police.
Even though ???? did not know the couples address, they had their phone number and constantly called them to try and resolve the issue.  Their way of resolving things was “pay us the money, drop the criminal case and you can have your Tapu’s”.  The Irish couple on my advice stood their ground and said “no, give us our Tapus, we will pay the rest of the money and do a disclaimer on the criminal charges”.  The stand off lasted a couple of weeks then on Christmas Day, ???? phoned to say, “come to the Tapu Office now and you can have your Tapu’s”.  They went immediately, got their Tapu’s, paid the money and made the disclaimer.
This is a splendid example of justice winning and proves that you can beat these scum.  ???? are a big Company here and have many officials in their pockets but they are unknown in Ankara.  If you can prove or indicate fraud it’s a completely different ball game to civil cases, with fraud, you go straight to jail.

This is one such example of an easy scam and one that many Europeans have fallen for.
This particular scam involves two Turkish partners.  First, they do the deal with a Brit over a beer and lots of smiles.  The Tapu (title deeds) are in only the one partners name, the money is sent to the other partner or their "company name" and the scam is on. The Brit gets nothing and takes them to court, the Tapu owner shows his bank accounts in court, no sign of money from the buyers, the case is thrown out.  Why? Because the owner of the Tapu never received the payment and if the other partner has spent the money he was given or used it to get himself out of debt, how can you get it back.  The judicial system will not jail him and you will have spent thousands of lira more on expensive, barely adequate lawyers.  People should ALWAYS send the money to the name on the Tapu and ensure that the Tapu is handed over at the same time.  No tapu...no money...simple!

I have spoken  to the Eyes Of Didim Complex landowner today, she said the court date for the hearing, regarding the apartments at Eyes Of Didim Complex,  is on 24th April.  The apartments will be valued on the 15th April.  From what I can understand, say, an apartment (1 bedroom) is valued at 60,000tl. The original Didim Design Group buyer will be given first refusal to buy it again.  If they decline, it then goes for auction.
 
You will notice that I have removed, by request, many personal details of people involved, due to the fact that intimidation and threats of severe violence have now started because of this website.  Some of the Brits involved are terrified.  

Word is spreading to the people that really matter!  Steve Pearson, at
livinginthesun.com has informed me that his company are now no longer selling property in Turkey and Cyprus because they know all about the problems.  Living In The Sun are one of the major players in the overseas property selling market and obviously have many contacts in the industry.  You can rest assured that the subject of Turkish property scams is going to be high on the agenda at the next overseas property fair in the UK if Steve Pearson has anything to do with it!

It has been confirmed that Tahsin Abali has written Senate/promissory notes on Didim Design Group Builders Company name for 1.354.000 Turkish Lira.  485,000 TL of this debt is owed to Kadriye Abali, (Tahsin's Mother)
These Didim Design Group Builders debts are now officially up to date, as passed as true DDG debts  by Didim Enforcement Office.
There are rumoured to be more creditors waiting in the shadows to claim monies owed to them........watch this space.

I have spoken to people in the know today in Didim.
Hassan Tahsin Abali is appearing in Didim Court, floor 2, for a criminal case being brought against him on Monday 14 March 2011.
It is alleged that Hassan Tahsin Abali wrote out and signed a Senate Cheque/Promissory note for over 200,000 Turkish Lira, knowing that this would bounce/not clear because there were insufficient funds in the issuers account and that the persons name on this document was not entitled to these monies in the first place.
 
I will update you on Monday 14th March after court hearing.

The website  altinkum-ripped-off.webs.com  has been blocked by the Turkish Government, so obviously, it's hurting and equally embarrassing for them.  I'm sure that this site will be next.
